Who publishes this site

This site is published by Birdtold. Correspondence goes to the desk at once@birdtold.me. Using this site means you accept these terms.

What this site is, and is not

The material here describes a service and reports on public regulatory and scheme developments. It is published for information. It is not legal advice, not regulatory advice, not financial advice, and not a recommendation to take or refrain from any action against any party.

Nothing on this site is an offer capable of acceptance. An engagement begins only under a separate written agreement between us and a client. Where these terms and that agreement conflict, that agreement governs.

What our findings assert

A finding asserts what was observed: that a payment was made to a named storefront on a stated date, that it settled, and what the artifacts of that settlement show about the descriptor, the merchant category code and the acquiring route.

A finding does not assert that any institution knew what it was processing, intended the outcome, or breached any rule or law. Those are conclusions for the party with the mandate to reach them. Any inference drawn beyond what the evidence states is drawn by the reader, not by us.

Findings describe a moment. Routes change. A finding is accurate as at its collection date and is not a representation about any later period.

Evidence packs and permitted use

Evidence packs, registry extracts, samples and screening lists are supplied to a named recipient for that recipient’s own compliance, supervisory, risk or enforcement purposes. They may be shared within the recipient’s group and with its regulators, its auditors, the relevant card scheme and its professional advisers.

They may not be republished, resold, redistributed to the public, used in marketing, or used to make a public allegation against a named institution without our prior written agreement. A redacted sample is supplied for evaluation only.

Onward use is subject to the right of reply. If you intend to name a party publicly on the basis of material we supplied, tell us first, so that the procedure at /legal/right-of-reply has been run before that happens.

Intellectual property

The text, layout, artwork, marks and compiled data on this site and in our deliverables belong to us or our licensors. You may read, quote briefly with attribution, and print for internal use. You may not scrape the site, mirror it, or use its content to train a model without our written agreement.

Acceptable use

Do not attempt to gain unauthorised access to any part of this site or its infrastructure, interfere with its operation, or submit anything through its forms that is unlawful or that you have no right to send us. Security research is welcome under /legal/responsible-disclosure.

Client access at /app is invite-only and is issued to a named individual at an engaged client. Credentials are not to be shared. Tell us immediately if you believe an account has been compromised.

Third parties

The booking widget on /contact is operated by a third party and loads only after you click to load it. Its own terms apply to your use of it. Links to external documents are provided so that a claim can be checked at source; we do not control those pages and are not responsible for their content.

Availability and liability

This site is provided as it stands. We do not warrant that it will be uninterrupted or error-free, and we may change or withdraw any part of it.

To the extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit, and loss arising from any decision taken in reliance on material published on this site, as distinct from a deliverable supplied under an engagement agreement. Liability for deliverables is governed by that agreement. Nothing here excludes liability for fraud, for fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Governing law

These terms are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction over any dispute arising from them.
